چکیده فارسی: کودک‌همسری از دیرباز یکی از موضوعات بحث‌برانگیز علوم مختلف، از جمله فقه و حقوق، بوده است و در جوامع و دوره‌های زمانی گوناگون مواجهه‌های متفاوتی به فراخور آداب ‌و رسوم و سنت‌ها با این پدیده صورت گرفته است. فارغ از موضوع‌شناسی، مجازبودن یا نبودن، جرم‌انگاری‌شدن یا نشدن این مسئله، کودک‌همسری به معنای به ازدواج درآمدن کودکان نابالغ است. این پدیده می‌تواند موجب ورود خسارات معنوی به کودک شود. خاستگاه‌های این خسارات ممکن است از جانب ولیّ یا زوج و زوجه باشد. این تحقیق با روش توصیفی‌تحلیلی و با مطالعه متون فقهی‌حقوقی با هدف شناسایی خاستگاه‌های خسارت معنوی ناشی از کودک‌همسری صورت گرفته است. یافته‌های تحقیق حاکی از آن است که «رعایت‌نشدن مصلحت کودک از جانب ولیّ»، «استمتاعات عام از کودک»، «استمتاع خاص از کودک و ازاله بکارت وی توسط زوج» و بعضاً «اصل تزویج کودک» از مهم‌ترین خاستگاه‌های خسارات معنوی ناشی از کودک‌همسری است که در طول تحقیق این خاستگاه‌ها و چگونگی ورود خسارات معنوی ناشی از آن، از منظر فقهی و حقوقی، بررسی شده است.

Origins of Moral Damage Caused by Child Marriage in Imami Jurisprudence and Iranian Law

English Abstract: Child marriage has long been one of the most controversial topics in various sciences, including jurisprudence and law, and this phenomenon has been encountered differently in accordance with customs and traditions in different societies and time periods, Regardless of the subject matter, whether it is permissible or not, whether it is criminalized or not, child marriage means the marriage of minor children. This phenomenon can cause moral damage to the child. The origins of this damage may be from the guardian or the spouse. This research has been done by a descriptive-analytical method through studying jurisprudential and legal texts with the aim of identifying the origins of moral damage caused by child marriage. The findings of the study indicate that "non-observance of the child's interests by the guardian", "general enjoyment of the child", "special enjoyment of the child and deprivation of virginity by the spouse" and sometimes "the principle of child marriage" are the most important origins of moral damage caused by child marriage. During the research, these origins and how they cause damage has been studied from a jurisprudential and legal perspective.
