چکیده فارسی: قواعد کلی فقه اسلامی و نیز ملاکات احکام دو ظرفیتی هستند که به کمک آنها فقه اهل بیت رشد یافته و بالنده شده است. فقها با استفاده از ظرفیت‌های هر یک از این عناوین کوشیده‌اند حکم موضوعات مستحدثه یا نیازهای نوپدید را تبیین کنند و فقه اهل بیت(ع) را به‌روز نگه دارند. مسائل جدید فقه خانواده نیز با استفاده از ظرفیت‌های یادشده به‌روزرسانی شده و احکام آن بیان شده است. نتیجه این تلاش‌ها توسعه کمّی و کیفی فقه خانواده بوده است، به‌گونه‌ای که امروز کمتر مسئله‌ای وجود دارد که در فقه، حکم آن روشن نشده باشد. این نوشتار می‌کوشد ضمن تبیین ظرفیت‌های فقه شیعه در به‌روزشدن و پاسخ­گویی به نیازهای نوپدید، تحولات حقوق خانواده و به‌روزشدگی آن را تبیین کند.

Imamiyah Jurisprudential potentialities and updating Family Jurisprudence

English Abstract: General principles of Islamic jurisprudence and criteria of ambivalent injunctions help Ahl ul bayt jurisprudence to expand and develop. Great jurists, utilizing the capabilities of each of these subjects, have tried to explain the unprecednted subjects or novel needs and make Ahl ul bayt jurisprudence to remain up to date. New matters of family jurisprudence have also been updated by usinng these capacities. The result of these efforts has been the qualitative and quantitative development of family jurisprudence, then there are few matters that are not specified in jurisprudence. The present paper tries both to explain the capability of Shiite jurisprudence in being modernized and its responding to novel requirements, and to specify the family law changes and its updating.
