چکیده فارسی: خانواده باسابقه‌ترین اجتماعی است که منبع تغذیه اجتماعات بزرگ انسانی از جنبه‌های مختلف است. این نهاد حقوقی، پیچیده و چندساحتی است. نظام‌های حقوقی بزرگ دنیا، علی‌رغم تفاوت در بنیانشان، کوشیده‌اند اهمیت و اقتضائات خاص آن را در منظومه کشورهای متبوعشان در نظر بگیرند و به خانواده در قاموس قوانین خویش توجه کنند. در اسلام نیز حقوق خانواده بخش مهمی از احکام و اخلاق را تشکیل می‌دهد. بر این اساس، بازخوانی و بررسی ظرفیت‌های حقوق خانواده در اتحاد حقوقی جهان اسلام مسئله‌ای ضروری است. در این مقاله می‌کوشیم ضمن پرداختن به جایگاه حقوق خانواده در نظام حقوقی اسلام، نقش حقوق خانواده را به عنوان یکی از ظرفیت‌های موجود زمینه‌ساز اتحاد حقوقی جهان اسلام مطمح نظر قرار دهیم. بر این اساس، پس از تبیین مشترکات محل اجماع در فرآیند پژوهش به مصادیقی طبق فتاوای مشهور فریقین در این زمینه می‌پردازیم و امکان تقریب در غیرمشترکات با دخالت‌دادن حقوق اسلامی و لزوم رعایت حق تحفظ را بررسی می‌کنیم. روش تحقیق در این پژوهش، تحلیلی‌توصیفی و مبتنی بر اطلاعات کتابخانه‌ای است.
Jurisprudence and Family Law Capacities in Legal Convergence of Muslim’s World
English Abstract: Family is the oldest community that is the origin of large human society from different aspects. This large institution that is influenced by its complex topic, and is constituted of human communities, is a complicated category that legal systems of the world, despite their disagreements in the basics, have considered its importance in their countries’ principles. In Islam, family law constitutes an important part of laws and ethics. So it is necessary to study and reread the capacities of family law in legal unity of Muslim’s world. In the present article, we are to examine the status of family law in Islam and its role in unifying Muslim’s world. So after clarifying the commonalities, we deal with the evidence of both sects, and seek to approach the noncommonalities by using the Islamic law and observing reservation right. The method of the research is analytical-descriptive and is based on library information
