چکیده فارسی: تحقیق حاضر با گذشتن از فراز و نشیب‌های نه دوره فقه شیعه در امر نشوز، با استفاده از منابع کتابخانه‌ای و روش توصیفی- تحلیلی، این بار مشکلات نشوز زوجین را در تعریف و دامنه و محدوده آن، با تشریح نظر و دیدگاه فقیهان در دوره‌های مختلف مورد ارزیابی قرار داده و مشخص نموده که تطورات دوران فقه تأثیری در پدید آمدن مشکلات موجود نشوز نداشته بلکه گذشت تدریجی دوران فقه شیعه، موجب تأثیر مثبتی بر روند شکل‌گیری و توجه به ابعاد تعریف نشوز در مردان شده است. غالب فقها نشوز را هم برای مرد و هم برای زن قائل شده‌اند و تعریفی که در طول دوران فقهی نسبت به نشوز زن شده تغییر قابل‌توجهی نداشته، فقط در مواردی با توجه به درکی که هر فقیه در زمان خود نسبت به چگونگی تمکین زن داشته کمی متفاوت شده است؛ اما تعریف و اسباب نشوز مرد در هر دوره نسبت به دوره پیشین واضح‌تر و روشن‌تر گردیده و جالب این است حتی در دوران جمود فقهی (عصر تقلید و عصر اخباریگری) نه‌تنها روند نزولی نداشته بلکه حرکت تکاملی را پیموده و نکته اساسی این است که در همه دورهها به رفتار عادلانه و اخلاقی مرد با زن توصیه‌شده و هر زمان نسبت به زمان قبلی، ابعاد آن روشن‌تر گردیده است.
Development of the Concept of Arrogance in Various Periods of Shia Jurisprudence
English Abstract: This research aimed at the development of the concept of arrogance in various periods of Shia jurisprudence based on a descriptive–analytical method and tried to investigate the problems aroused regarding couple’s arrogance based on the Islamic jurisprudents’ viewpoints. It was found that developments of the Shia jurisprudence had no negative impacts on the concept of arrogance in the various periods of time. None the less, Shia jurisprudence has had positive impacts on the definition of concept of arrogance in men, and a majority of Islamic jurisprudents have considered the concept of arrogance for both women and men. There was no significant change in the definition of arrogance throughout the history of Shia jurisprudence and there was only a little change in its definition based on the conditions of different times. Generally speaking, the definition and causes of arrogance in men has become more and more clear and obvious compared to the previous periods of time. Conducting a good and fair behavior by the men towards women has been emphasized in different periods of time and its dimensions have become clearer compared to the last periods of time.
