چکیده فارسی: در نظام فقهی حقوقیِ خانواده، حق نامگذاری کودکان به والدین کودک اعطا شده و کودک نیز حقوق متعددی بر نام خود دارد.«نام» یک پدیدۀ چند وجهیِ فرهنگی، تاریخی، سیاسی، روانشناسی، جامعهشناسی و حقوقی است و گاهی در مقولاتی نظیر نام تجاری، آثار اقتصادی نیز دارد که در طول زمان متحول شده است. با عنایت به فلسفۀ حقوق که نظم بخشی به پدیدههاست، هر نوع قاعدهگذاری درخصوص نامها، وجوه فوق را تحت تأثیر قرار میدهد. به رغم اهمیت آثار فوق، تاکنون مطالعات جامعی دراین خصوص صورت نگرفته است که ضرورت پژوهش حاضر را مضاعف میکند. سؤال اصلی آن است که دامنۀ «حقوقِ بر نام» کودک تا کجاست و چگونه حقوق فوق، استیفاء و تضمین میشود؟ نگارنده ضمن استفاده از روش هرمنوتیک به این باور رسیده است که دامنۀ حقوقِ بر نامِ کودکان گسترده است و حق انتخاب نام، حق داشتن نام مناسب، حق داشتن نام مشابه، حق ثبت نام، حق تغییر نام و حق تبلیغ نام، بخشی از مصادیق آن است. به نظر میرسد اولیای کودک و کودکِ ممیز، حق استیفای حقوق فوق را دارند؛ لیکن رویۀ قضایی دراین خصوص منسجم نیست و نظام قانونی نیز، ناقص و مجمل است و نیاز به اصلاح دارد. پیشنهاد میشود قانونگذار در قوانین ثبت احوال یا مدنی یا حمایت خانواده، به طور صریح حقوق مزبور را به رسمیت بشناسد و مقام صالح برای استیفاء و دیگرتشریفات آن را مشخص کند و در قانون حمایت از اطفال و نوجوانان، مصادیق مجرمانۀ آن را تبیین کند. نگارنده دو مادۀ پیشنهادی را جهت تصویب مطرح کرده است.
The Right to a Child’s Name in Iranian and American Law
English Abstract: In the jurisprudential–legal framework of family law, the right to name a child is entrusted to the parents, while the child also enjoys several entitlements concerning their name. A “name” is a multifaceted phenomenon encompassing cultural, historical, political, psychological, sociological, and legal dimensions, and in certain contexts—such as trade names—it carries economic implications that have evolved over time. Since the philosophy of law aims to regulate social phenomena, any legislative intervention regarding names inevitably affects these dimensions. Despite the significance of this issue, comprehensive research remains scarce, which highlights the necessity of the present study. Adopting a hermeneutic and comparative method with reference to American law, this research investigates the scope of a child’s rights to a name. These rights include the right to choose a name, the right to an appropriate name, the right to a similar name, the right to register a name, the right to change a name, and the right to publicize a name. Both parents and discerning minors are entitled to exercise these rights. However, judicial practice in this area remains inconsistent, while existing legislation is fragmented and insufficient. Accordingly, it is recommended that legislators explicitly recognize these rights in civil registration, civil, and family protection laws, while also designating the competent authority for their enforcement. Furthermore, the Law on the Protection of Children and Adolescents should clearly identify the criminal dimensions of violations in this regard.
