چکیده فارسی: زن به عنوان جنسی از بشر در نظام آفرینش محل ظرفیت پذیرش نقش های گوناگون است و همواره مبتلابه حق‌ها و مسئولیت‌های متناسب با ذات خویش در نگاره‌های متفاوت (همسری، مادری و ...) می‌باشد که هر کدام از این نقش‌ها واجد اقتضائات حقوقی خاصی هستند. دو گانه‌ی «زنانه- مادرانه» یا «همسرانه-مادرانه» از جمله نقش ها و ساحت هایی است که این جنس از بشر در دو سر طیف آن حضور می یابد. نقطه عزیمت این بحث، گذار به نقش همسرانه و سپس نگاره‌ی مادرانه در پرتو حمایت های ارفاقی (ایجابی و سلبی) از نوع هنجاری-قانونی است که در این مقاله سعی بر نقد و بازنمایی وضعیت نامطلوب موجود و شناسایی ظرفیت‌های موجود برای نیل به وضعیت بهینه در ارتقاء جایگاه وی به نقش-های دوگانه موصوف و تلاش برای ایجاد توانمندسازی در این راستا بوده است. از این رو با نگاهی به وجوه سه‌گانه اجتماعی، اخلاقی و خانوادگی، ضمن ارزیابی کاستی‌های حقوقی، با واکاویِ وثیق درصدد معرفی ظرفیت‌های قانونی برای ارتقاء و توانمندسازی زنان در جایگاه همسری و مادری برآمده و راهبردهایی برای تحول تصمیمی و تقنینی در سطوح سیاست‌گذاری تا تاکتیک‌های اجرائی، در هر حوزه ارائه می‌شود.

Female-maternal legal empowerment in the tendency to have children; From social-administrative law to central-family law

English Abstract: As a gender of human beings in the system of creation, the woman has the capacity to accept various roles and always has the rights and responsibilities according to her nature in different images (wife, motherhood, etc.), each of which Some of these roles have special legal requirements. The duality of "feminine-maternal" or "wife-maternal" is one of the roles and fields that this species of human being is present at both ends of its spectrum. The point of departure of this discussion is the transition to the wifely role and then the motherly image in the light of social support (positive and negative) of the normative-legal type. Achieving the optimal situation in upgrading his position to dual roles and trying to create empowerment in this direction. Therefore, by looking at the social, moral and family aspects, while evaluating the legal shortcomings, with a thorough analysis, it tries to introduce the legal capacities for the promotion and empowerment of women in the position of wives and mothers, and strategies for decision-making and legislative transformation. It is presented in every field, from policy-making to executive tactics.
