چکیده فارسی: حسب ماده 1117 قانون مدنی و ماده 18 قانون حمایت خانواده مصوب 1353 شوهر میتواند در فرض تأیید دادگاه زن را از شغلی که منافی با مصالح خانوادگی باشد، منع نماید. در فرضی که تعهدات قراردادی زوجه قائم به شخص باشد، حدود امکان منع از جانب زوج، وضعیت التزامهای زوجه و جبران خسارت حاصل شده به کارفرما محل بحث است. در ادبیات حقوقی کشورمان در رابطه با سه امر فوق تشتت آراء وجود دارد. یافته پژوهش حاضر که به صورت توصیفی-تحلیلی و بر اساس روش کتابخانهای نگاشته شده، بر آن است اگر اشتغال زوجه به بقاء و کارکرد نکاح ضرری قابلتوجه از نظر عرف وارد کند، منع از اشتغال حکم بوده و قرارداد بین زوجه و متعهدله باطل است و زن دارای مسئولیت مدنی هست. البته اگر علّت منع از جانب زوج پس از تشکیل قرارداد حادث شده باشد، عقد منفسخ میشود. در فرض اخیر در صورت تخلف از تعهد قراردادی و یا شرط مسئولیت، زوجه مسئولیت قراردادی خواهد داشت. در صورتی که آسیب وارد شده به نکاح و کارکرد آن از منظر عرف قابل اعتناء نباشد، منع از اشتغال حق مرد بوده و قرارداد پس از منع منفسخ میشود. در فرض اخیر زوجه نسبت به متعهدله تنها در صورتی که تصریح شده باشد، مسئولیت قراردادی دارد.
Contractual obligations and the wife's responsibilities in the event of the husband's prohibition from continuing employment
English Abstract: According to Article 1117 of the Civil Code and Article 18 of the Family Protection Law approved in 1353, the husband assuming the approval of the court can prohibit the wife from a job that is against the family interests. In the assumption that the contractual obligations of the wife must be performed on her own behalf, the extent of the husband's ability to impose restrictions, the status of the wife's obligations and the compensation for the damage to the employer is a matter of debate. There is a divergence of opinions in our country's legal literature regarding the three aforementioned matters. The findings of the present research are that If the wife's employment significantly harms the continuation and functioning of the marriage in terms of custom, then prohibiting her from working is a task, and the contract between the wife and the promisee is void, and the woman bears civil liability. Of course, if the reason for the prohibition arises after the contract has been formed, the contract automatically is terminated. In the latter case, in the event of a breach of the contractual obligation or responsibility condition, the wife will be contractually liable. If the damage done to the marriage and its functioning is not significant from the perspective of custom, the man can prohibit her from working and the contract automatically is terminated after the prohibition. In the latter case, the wife has contractual liability towards the obligee only if it is specified.
