چکیده فارسی: سقطجنین مسئله پیچیدهای است که علاوهبر اینکه رفتاری باروری- جنسی است، یک معضل مهم سلامت عمومی و سلامت زنان نیز درنظر گرفته میشود. در ایران بهرغم محدودیتهای قانونی و مذهبی که این اقدام را تنها در شرایط خاصی مجاز میداند، کماکان سقط جنین عمدی انجام میشود. این مطالعه با رویکرد کیفی ادراک زنان دارای همسر از احکام و قوانین سقط جنین در ایران را شناسایی کرده است. دادهها از تیر تا آبان سال 1403 با ابزار مصاحبه عمیق جمعآوری شد. تحلیل دادهها با رویکرد تحلیل مضمون به روش براون و کلارک انجام شد. تعداد افراد نمونه 46 زن ازدواج کرده در شهر تهران بود که در سال 1403 بهصورت هدفمند و گلوله برفی و مراجعه به پزشک و ماما شناسایی شدند. یافتهها نشان داد که سطح آگاهی زنان نسبت به این موضوع پایین و ناقص است و این کمبود آگاهی نقش قابلتوجهی در تصمیمگیریهای آنان دارد. از تحلیل دادهها، چهار مضمون اصلی شامل شناخت اندک یا برداشت نادرست از استثنائات شرعی و قانونی، سادهسازی و توجیهسازی دینی سقط جنین، تضعیف نقش مذهب و قانون در تصمیمگیریها، و مراجعه به منابع غیر رسمی و باز تولید اطلاعات نادرست استخراج شد. این مضمونها به یک مضمون نهایی با عنوان «فاصله شناختی با واقعیتهای فقهی-حقوقی سقط جنین» منجر شد. نتایج این پژوهش بر ضرورت افزایش آگاهی زنان از قوانین و احکام شرعی سقط جنین از طریق آموزشهای عمومی تأکید دارد، تا از پیامدهای منفی ناشی از تصمیمات نادرست و ناایمن در این زمینه جلوگیری شود.
Identification of Married Women's Perceptions of Legal and Jurisprudence Rules on Abortion in Iran
English Abstract: Abortion is a complex issue that, in addition to being linked to reproductive and sexual behavior, is considered a significant public health concern and a critical women’s health challenge. In Iran, despite legal restrictions that permit abortion only under specific circumstances and religious prohibitions deeming intentional abortion "haram" (religiously forbidden), such procedures persist. This study, using a qualitative approach, explored the perceptions of ever married women regarding abortion laws and regulations in Iran. Data were collected through in-depth interviews from July to November 2024. The data were analyzed using thematic analysis based on Braun, and Clarke’s method. The sample size was 46 married women in Tehran who were identified through purposeful and snowball sampling and referrals to doctors and midwives. The findings showed that women's level of awareness about this issue is low and incomplete, and this lack of understanding plays a significant role in their incorrect decision-making. From the data analysis, four themes were extracted: limited understanding or misinterpretation of religious and legal exceptions, religious simplification and justification of abortion, weakening of the role of religion and law in decision-making, and reliance on informal sources and reproduction of misinformation. These categories ultimately led to a core theme titled "Cognitive distance from the Jurisprudence-Legal realities of abortion." The results of this study emphasize the need to increase women’s awareness of the laws and Sharia rulings on abortion through public education, to partially prevent the negative consequences of incorrect decisions in this area.
