چکیده فارسی: یکی از مباحث اختلافی میان اندیشمندان فقه و حقوق عقد معلق و آثار اقسام تعلیق است. در این بین، تعلیق مهریه به دلیل اختلاف در ماهیت و نوع ارتباط آن با عقد نکاح و بطلان نکاح معلق، می‌تواند محل بحث و تأمل باشد که در آثار علمی این مورد بررسی نشده است. جایگاه متفاوت مهریه در نکاح موقت و دائم، آثار مختلف تعلیق در انشاء و تعلیق در منشأ، وضعیت مهریه‌ی معلق در موارد انحلال نکاح، تحقق یا عدم تحقق معلق‌علیه قبل یا بعد از وقوع نزدیکی و محاسبه به نرخ روز مهریه‌ی معلق مباحثی هستند که در این پژوهش با روش توصیفی و تحلیلی بررسی شده‌‌اند. به اجمال می‌توان گفت، تعلیق مهریه به طور مطلق نکاح موقت را باطل می‌کند، اما تعلیق مهریه در نکاح دائم به دلیل ماهیت قراردادی و مستقل مهریه از نکاح، ممکن است؛ هر چند تعلیق در انشاء و منشأ آثار متفاوت دارد.
The suspension of the Marriage Portion (MAHR)
English Abstract: The Suspended Contract and the types of Suspension’s effects are one of the disagreements between scholars of jurisprudence and laws. Meanwhile, the suspension of the Marriage Portion (MAHR) due to the difference in the nature and type of connection with the marriage contract and suspended marriage invalidity can be debatable and contemplated that has not been studied in scientific papers. Differences of marriage portion on temporary and permanent marriage, various effects of suspensions, the legal status of suspended marriage portion in cases of marriage dissolution, Calculate the day rate of suspended marriage portion and etc. are the topics that has been discussed in this research It can be said that the suspension of the marriage portion completely invalidates the temporary marriage, but the suspension of the marriage portion in the permanent marriage is possible due to the contractual and independent nature of the marriage portion.
