چکیده فارسی: یکی از آثار نکاح، تشکیل خانواده و داشتن اولاد است. بی تردید، فرزنددار شدن از طبیعی ترین و کهن ترین دلایل عقد ازدواج است، اما امروزه تأخیر در فرزندآوری یا تعطیل زوددرس فرزنددار شدن به یکی از معضلات خانوادگی و اجتماعی تبدیل شده است. احتراز از اختلافات بین زوجین و در نظر گرفتن مصالح کشورهای اسلامی در موضوع اشاره شده نیازمند بررسی های دقیق تری است. این مقاله، اهمیت و جایگاه فرزندآوری یا عدم آن را در روابط خصوصی زوجین بررسی و موارد جواز و عدم جواز شرط فرزندآوری یا شرط عدم فرزندآوری و اطلاق عقد نکاح از حیث اندراج شرط مذکور و حقوق هر یک از طرفین در صورت عقیم بودن همسر یا عدم توافق بر فرزنددار شدن و پیشگیری از بارداری در صورت عدم موافقت همسر را تبیین کرده است. بررسی اهمیت فرزندآوری در سرنوشت جامعه ی مسلمین و ضرورت حمایت دولت و خانواده ها از این کارکرد خانواده نیاز به تحلیل ابعاد اقتصادی و جامعه شناختی و سیاسی موضوع خواهد داشت که از حوزه ی این مقاله خارج است.

Fertility Prenuptial Agreement in marriage

English Abstract: Family settlement and bearing offspring are one of the outcomes of marriage. Despite the fact that having children is de facto the oldest and most natural motive behind joining in matrimony, currently postponed childbearing or early stopping of childbearing has demonstrated to be problematic for family and society. A more in depth study in this area is required in order to avoid family disputes and consider the expediency of Islamic countries. The current study aims to explain the significance of childbearing or its halt on private relationship of couples as well as instances where stipulating childbearing is permitted or forbidden. Also the stipulation of non-childbearing in marriage and the rights of each party in the event the other is infertile or not reaching agreement over childbearing and birth control, is examined. The impact of childbearing on the future of Islamic world and the need for government and families to take action and support this function requires an economic, social and political analysis which is beyond the scope of present article.
