چکیده فارسی: مطابق قواعد فقه امامیه استمتاع از زوجه ی نابالغ مطلقاً ممنوع است، لیکن در بسیاری از کتب فقهی متأخر امامیه فتوایی مشاهده می شود که ظاهر آنها در نگاه اوّل موهمِ جواز برخی از استمتاعات غیر متعارف از زوجه ی نابالغ است. وجود این قبیل فتاوی موجب طعن و اتهام تجویز کودک آزاری در آموزه های اصیل اسلامی توسط برخی از افراد مغرض شده و دستاویز هجمه ی ایشان به مرجعیتّ و آموزه های ناب فقه جعفری گشته است. جستار حاضر با تعمّق در عبارات فقها اتهام فوق را با این استدلال که فقهای مزبور در مقام بیان حکم اوّلی بوده و اصولاً متعرض حکم مسئله با عنوان ثانوی نشده اند، مردود دانسته است. نگارنده سپس در جستاری مبسوط در ادلهّ و مستندات فقهی و با استناد به عمومیتّ قاعده ی نفی ضرر درصدد اثبات این امر برآمده است که سخن صحیح و منطبق با قواعد فقه امامیه ممنوعیت مطلق استمتاعات از زوجه ی نابالغ می باشد.
