چکیده فارسی: هدف این پژوهش، بررسیرفتار یا گفتار و... تحریک آمیز بزه­دیده است که زمینه ساز بزه می­شود و براساس بند پ ماده 38 قانون مجازات اسلامی 1392 سبب تخفیف مجازات مرتکب می­گردد. در این پژوهش از روش توصیفی - تحلیلی با استفاده از ابزار کتابخانه­ای و نمونه‌برداری از 60 پرونده از پرونده­های مطروحه زنان بزهدیده در محاکم قضائی شهر شهرکرد صورت گرفته است. شیوه­ی استفاده از پرونده­ها به این گونه بوده که همه­ی پرونده­ها مورد مطالعه قرار گرفت و از بین این پرونده­ها، آنهایی که به گونه­ای بزه­دیده نقش مؤثری در ارتکاب جرم داشته انتخاب شد و سپس به تجزیه و تحلیل بحث پرداخته شد و در نهایت تأثیر رفتارهای زمینه­ساز جرائم جنسی و نقش آن در تخفیف مجازات در رویه قضائی و محاکم ایران بر اساس مبانی فقهی و حقوقی نتیجه‌گیری شد. یافته­های این پژوهش، بیانگر آن است که اولاً، گاهی اوقات رفتارها و گفتارهای بزه­دیده زمینه­ساز ارتکاب جرائم جنسی می­شود؛ ثانیاً اعمال و رفتار زمینه ساز جرائم جنسی و منافی عفت نه تنها سبب تخفیف مجازات مرتکب می شود، بلکه گاه سقوط مجازات بزهکار را موجب می­شود؛ ثالثاً تخفیف و سقوط مختص به تعزیر نبوده و به جرایم حدی و قصاص نیز تعمیم می یابد.

The Behaviors and Speeches That Underlie Sex Crimes from the Point of View of Islamic Jurisprudence, Law, and Iran's Judicial Procedures: A Case Study on Delinquent Women in the City of Shahrekord.

English Abstract: The purpose of this research is to investigate the behavior or speech and ... provocative of the victim which is the cause of the crime and, according to Article 38 of the Islamic Penal Code 1392, commits a reduction in the punishment. In this research, a descriptive-analytical method was used using library tools and sampling of 60 cases of victimized women in the judiciary in Shahrekord. The way in which files were used was that all cases were studied, and among these cases, those who were victimally, had an effective role in committing a crime. Then, the analysis of the discussion was dealt with. Finally, the effect of the underlying causes of sexual crimes and their roles in reducing the punishment in the Iranian judiciary and courts based on jurisprudential and legal foundations was investigated. According to the findings of this research, firstly, the behaviors and speeches of the victim are the basis for committing sexual offenses. Secondly, the actions and behavior that underlie sexual offenses and chastity do not only reduce the punishment of the perpetrator, but also sometimes lead to the fall of the criminal punishment. Thirdly, discounts and deductions are not specific to Ta'zir, and generalization is also applied to extrajudicial incidents and retaliation
