چکیده فارسی: یکی از اقسام خشونت که نیازمند توجه بیشتر و همه­جانبه در جامعه کنونی است، خشونت جنسی کلامی است؛ بخصوص که امروزه با رشد روزافزون میزان طلاق، شاهد افزایش این نوع خشونت علیه زنان هستیم. بر این اساس، شناخت قلمرو آن در متون فقهی-حقوقی و ارائه آگاهی­های حقوقی پیشگیرانه و حمایت قانونی از زنان در معرض خشونت کلامی خانوادگی، ضروری است. بررسی این موضوع، مستلزم پرداختن به آراء فقها و حقوقدانان، کاوش در مواد قانونی کشور ایران اسلامی و مدّ نظر قراردادن حکم عقل، بنای عقلاء و آیات و روایاتی است که به مناسبت­های مختلف، به دفاع از حقوق زوجه در قبال تجاوزات زوج در عرصه کلام برخاسته­اند. بررسی موضوع نشان می­دهد، اگرچه در روابط زوجین ریاست خانواده از خصایص شوهر است ولی این امر اطلاق ندارد و زوج ملزم به حسن معاشرت و معاضدت در زندگی مشترک است و قانون­گذار با تحدید میزان اختیارات ریاستی شوهر، اهتمام ویژه بر حفظ حقوق زوجه دارد.

Verbal Violence against Women and Legal Approaches to Deal with it

English Abstract: One of the forms of violence that needs more attention in our society is verbal sexual violence; with the increasing growth of divorce rate we see an increase in this kind of violence against women. Accordingly, it is necessary to recognize its territory in legal texts and provide legal awareness and legal protection of women exposed to family verbal violence. Examining this issue involves addressing the opinions of jurists and lawyers, exploring the legal materials of the Islamic Republic of Iran, and considering the judgment of reason, rationales, verses, and narrations that, on various occasions, protect the rights of the wife against verbal aggression. Though husband is the head of family in the family relations but his presidency is not categorical. Husband is obliged to have good communication with his wife and to be a good assistant and supporter for her in their common life. Limiting the powers of the husband's presidency, legislator should effort to preserve the rights of wife.
