به موجب صدرِ اصل «115» قانون اساسی، رئیس جمهور بایستی از میان رجال مذهبی و سیاسی انتخاب شود. عده‌ای با اشاره به معنای لغویِ این عبارت، قائل به عدم جواز قانونیِ ریاست‌جمهوریِ زنان هستند. در مقابل، تعدادی از صاحبنظران کلمۀ «رجال » را به «شخصیت‌های برجسته» معنا کرده و بر این عقیده‌اند که در صورت احراز سایر شرایط مندرج در اصل «115» قانون اساسی، هیچگونه منع قانونی برای ریاست‌جمهوری زنان وجود نخواهد داشت. در این میان، عدم اعلام نظریه‌ی تفسیری شورای نگهبان در خصوص معنای عبارتِ مذکور، موضوع را پیچیده‌تر کرده است.
در این مقاله، پس از اشاره به دلایل موافقین و مخالفین با ریاست‌جمهوری زنان، مذاکرات مطروحه در مجلس بازنگری نهایی قانون اساسی مورد بررسی قرار گرفته و به منظور درکِ موضعِ دیگر کشورهای اسلامی در این رابطه، شرایط احراز پست ریاست جمهوری در قوانین اساسی برخی از این کشورها، تبیین خواهد شد. در نهایت، این ایده مطرح می‌شود که کلمه‌ی رجال در اصل «115» منحصر به مردان نبوده و می‌توان قائل به امکان قانونیِ ریاست‌جمهوری زنان شد.
A Legal Reflection on the Meaning of ‘Men’ (Rijal) in Article 115 of the Constitution
English Abstract: According to Article 115 of the Constitution, the President must be elected from religious and political men (rijal). Some people, referring to the literal meaning of this article, argue that women's presidency is legally impermissible. Conversely, a number of experts have interpreted ‘Rijal’ as ‘prominent figures’ and believe that if other terms of the article are acknowledged, there will be no legal prohibition on women's presidency. Meanwhile, since Guardian Council has not declared its interpretation of the meaning of the article, the issue has been more complicated. Indicating proponents’ and opponents’ reasons for the women's presidency, this paper will examine the raised discussions in the parliament for final revising of constitution. And in order to understand the position of other Islamic countries on this issue, the conditions of presidency authentication in the constitution of some of these countries will be explained. Finally, one can plausibly argue that the word ‘Rijal’ in the article is not exclusively denoted to men and one can consider the legal possibility of women's presidency.
