چکیده فارسی: در طراحی مقررات حاکم بر خانواده، در حکم مهم‌ترین نهاد جامعه، قانون‌گذار باید به مصالح گوناگون اجتماعی، خانوادگی و فردی توجه داشته باشد و در سازش میان آن‌ها بکوشد. در این میان، مقررات شکلی ناظر بر رسیدگی به دعاوی خانوادگی و نیز اجرای احکام صادرشده از دادگاه حائز اهمیت ویژه است؛ زیرا شایسته یا نامطلوب بودن مقررات حاکم بر مرجع رسیدگی‌کننده و شیوة رسیدگی در میزان اختلافات خانوادگی تأثیر مستقیم دارد. هم‌چنین شرایط و نحوة اجرای احکام دعاوی خانوادگی و ضمانت اجراهای پیش‌بینی‌شده برای آن در پیش‌گیری از تبعات اجتماعی ناشی از اجرای احکام مزبور یا ایجاد معضلات اجتماعی تأثیر دارد. این جستار با بررسی قانون جدید حمایت از خانواده مصوب 1391، به این نتیجه رسیده است که قانون‌گذار در عرصة رسیدگی به دعاوی و اجرای احکام مربوط به آن، بر قواعد مناسبی تأکید کرده یا قواعد مناسبی را وضع کرده است. اجرای شایستة مقررات مزبور موجب استحکام بنیاد خانواده و ادارة بهتر دعاوی خانوادگی می‌شود.
Innovations in Family Protection Law: Procedural Rules Related to Family Disputes Approved in 1391/2013
English Abstract: The legislator should take into consideration various social, family, and individual expediencies while planning laws governing family, as the most important social institution, and should attempt to make compromises among them. In the meanwhile, procedural laws governing family disputes and enacting the laws issued by the court are crucially significant since the appropriateness or inappropriateness of the laws and the methods of settling disputes have a direct effect on the rate of family disputes. Moreover, the conditions and method of enacting family-related laws and the predicted assurances for their enactment can influence and prevent social consequences and social problems related to enacting such laws. The present study, while studying the new family protection law, approved in 1391/2013, shows that the legislator has focused on or established proper rules and regulations in case of proceeding disputes and enacting due laws. Proper enactment of such laws can strengthen families and lead to better management of family discords.
