چکیده فارسی: رعایت حقوق جنسی ازجمله مصادیق حسن معاشرت است و خودداری زوج نسبت به تأمین نیاز جنسی زوجه به‌‌صورتی‌‌که زن رضایت روانی، جسمی و عاطفی نداشته باشد، می‌‌تواند یکی از موارد نشوز مرد باشد. پژوهش حاضر به‌روش اسنادی- تحلیلی و با هدف بازکاوی فقهی- حقوقی حق استمتاع زوجه، به‌عنوان مصداقی از حسن‌معاشرت، با تأکید بر لزوم مزاج‌شناسی زوجین انجام شد. بدین‌منظور کلیه منابع مکتوب مربوطه اعم از کتب و مقالات علمی مورد بررسی قرار گرفت. براین‌اساس توسعه در مفهوم حق استمتاع، توجه به ضرورت بازنگری در دیدگاه‌‌های فقهی و قوانین مدنی حول محور حقوق جنسی زوجه و تبیین حدود معاشرت به‌معروف در مناسبات زوجین برمبنای تأمین غریزه جنسی زوجه بررسی و تحلیل شد. نتایج نشان داد که باتوجه به انحصار تأمین نیاز جنسی زن از سوی شوهر و الزام شرعی و قانونی ایشان به رعایت حسن‌معاشرت، برای دستیابی به اهدافی همچون افزایش میزان تعهد زناشویی، حفظ حیا در میان زنان، استواری بنیان خانواده و کاهش آمار طلاق، حق استمتاع زوجه باید در قانون تصریح شود و در حیطه سیاست‌‌گذاری و اجرا نیز این حق به‌عنوان یکی از اصلی‌‌ترین لوازم تحکیم بنیان خانواده، مورد توجه قرار گیرد. همچنین ضمانت اجرایی نظیر الزام زوج به اخذ مشاوره در این زمینه مورد تأکید قانون‌گذار باشد.
A Jurisprudential-Legal Analysis of Wife's Right to Sexual Pleasure with an Emphasis on the Necessity of Knowing Couples' Temperament
English Abstract: Observing sexual rights is one of the instances of good companionship and refusing husband to satisfy wife's sexual desire, so that she does not have a psychological, physical, and emotional satisfaction, can be one of the cases of disobedience. This documentary-analytical study was conducted with the purpose of analyzing jurisprudentially-legally wife's right to sexual pleasure, as an instance of good companionship, emphasizing the necessity of knowing couples' temperament; thus, all related written sources including books and scientific papers were reviewed. Therefore, the followings were analyzed: the development of the concept of right to sexual pleasure, the necessity of reviewing jurisprudential opinions and civil law related to wife's sexual rights, and the explanation of good companionship in couples' relations based on satisfying wife's sexual instinct. According to the results, due to husband's monopoly in meeting wife's sexual desires and his Sharia and legal obligation to good companionship, for achieving goals such as increasing marital commitment, maintaining modesty among women, strengthening family foundation, and decreasing divorce rate, wife's right to sexual pleasure should be clarified in law and in the realm of policymaking and execution, that right should also be considered as one of the most important factors of strengthening family foundation. Moreover, the legislator should emphasize the executive guarantee like the obligation of husband to be informed about this issue.
