چکیده فارسی: یکی از دلایل عقلی جهت سلب مباشرت از دختران بالغ در امر نکاح، سریع‌التأثیری و غلبة احساس بر قوة عقل است که مانع از انتخاب زوجی هم‌کفو می‌شود. این امر مورد استناد طرفداران استقلال اولیا در عقد نکاح در فقه امامیه، قانون مدنی، و نظر جمهور فقهای اهل‌سنت در احوال شخصیه ایرانیان غیرشیعه است، درحالی‌که در برخی اسناد حقوق بشر و همچنین در آرای برخی از فقهای امامیه واهل‌سنت، استقلال در عقد نکاح برای دختران به رسمیت شناخته شده است؛ ازاین‌ر‌و، نویسنده، به شیوة توصیفی ـ تحلیلی درصدد بررسی عمده دلیل منع استقلال دختران بالغ در امر نکاح مبنی بر ناتوانی از انتخاب زوجی هم‌کفو به علت عدم خبرگی و سریع‌التأثیری است که امروزه درعلم روان‌شناسی با تقویت هوش هیجانی می‌توان سریع‌التأثیری را برطرف کردو به رشد نکاحی(معرفت به انتخاب زوج هم‌کفو) رسید.
The Independence of mature girls in marriage in Iranian law, Jurisprudence of Islamic religions and international documents
English Abstract: A quick effect and overcome feeling on the power of intellect which gets prevents selection homologous paired is a matter which, as an intellect reason aim deprivation superintendence of mature girls in marriage is set select item advocators independence guardians in marriage in Imamiyah jurisprudence, article 1043 of the civil code, and the public opinion of Sunni jurists on non Shiite Iranians personal status. Independence of girls in marriage is recognized in some international human rights documents as well as some views of Imamiyah and Sunni jurisprudence. So that this research with descriptive analytic method is studying the main reason for preventing the independence of mature girls in marriage in marriage based on the inability to choose homologous paired due to lack of experience and quick effect.Today this topic can be removable simply in the light of modern psychology science and strengthening emotional intelligence which lead to growth in marriage.
