چکیده فارسی: طبق ق.م.ا، برای اعمال طبی باید از فرد یا ولی وی رضایت گرفت. در مراکز درمانی، متعارف است که برای انجام اعمال طبی زوجه از زوج نیز رضایت می‌گیرند. این مقاله در صدد بررسی این موضوع و حدود و ثغور آن است. در ادامه، به بررسی این مسأله پرداخته شده است که هزینه­های درمان زوجه از مصادیق نفقه‌ زوجه محسوب می‌شود یا خیر؟ و آیا مرد مکلف به پرداخت هزینه­های اعمال جراحی زیبایی زوجه است؟ یافته‌های این‌ تحقیق نشان می‌دهد زمانی که زوجه عاقل و بالغ باشد، نیازی به رضایت زوج نیست؛ اما اگر به دو وظیفه‌ ولایت و ریاست مرد بر زن و نیز تکلیف تمکین زوجه در قبال زوج خدشه‌ای وارد سازد، ممنوع است. در جراحی زیبایی، اگر زوجه بدون دلیل موجه ممانعت کند به جهت منع سوءاستفاده از حق، زوجه نیازمند اذن زوج نیست. جراحی زیبایی زوجه در جایی که با اهداف ضروری صورت بگیرد، زوج مکلف به تأدیه‌ مخارج درمان است و در موارد غیرضروری، مرد قانوناً مکلف به تأدیه‌ این قبیل مخارج نیست؛ اگرچه ممکن است عرف، اخلاق یا ملاحظات دیگر مشوّقی برای تأدیه‌ این مخارج باشد. کوتاه‌سخن این‌که ملاک تعیین نفقه‌ زوجه، علاوه بر شؤون مشارالیها، تمکن مالی، شأن و موقیعت اجتماعی زوج نیز می‌باشد.

An Islamic Jurisprudential-Law Study on Husband's Permission for Wife’s Cosmetic Surgery

English Abstract: According to the Islamic Penal Code, permission is required before any medical surgery from an individual or her/his guardian. In the medical centers, it is also common to ask for the husband’s consent for his wife’s medical treatment. The present study seeks to investigate this issue as well as the restrictions of concern. The questions like whether the cost of treatment is an example of wife’s alimony or whether the husband is obliged to pay the cost of his wife’s cosmetic surgery have been considered in this research. The findings show that a mature and sane wife does not need her husband’s permission to undergo the surgery unless there is disrespect to the matrimonial duties such as husband’s superiority over wife or wife’s obedience to the husband. If the wife is prevented from surgery without due justification, she would be able to pursue her will. In case of necessity, the husband should pay the cost unless otherwise; although he may like to fund the surgery for the matter of ethic or personal purpose. The criterion for determining the alimony of the wife in addition to the aforementioned values is the financial condition, dignity and social situation of the husband.
