چکیده فارسی: قواعد فقه خانواده گزاره‌های کلی و عام فقهی هستند که مبنای برخی از قواعد حقوقی در حقوق خانواده تلقی می‌شوند. قواعدی چون «رضاع»، «فراش»، «المطلقه الرجعیه زوجه حقیقه»، از جمله قواعد اختصاصی خانواده به‌شمار می‌آیند که تنها در حقوق خانواده کاربرد دارند. مقاله حاضر، مفاد، مستندات، شرایط اعمال و مباحث فقهی هر یک از این قواعد را در آرای فقیهان متأخر و متقدم بررسی می‌کند و انعکاس قواعد اختصاصی فقه خانواده را در مواد قانونی مدنی ایران نشان می‌دهد.
The Peculiarities of Family Jurisprudential Rules & its Applicability in Civil Law
English Abstract: Family jurisprudential rules are composed of general & universal decree of theology, which are the basis of some family legal rules. Laws related to “Resa”, “Ferash”&“Almotalaghe Alrojieh” are specific family rules are only included in family law. The present article studies the content, the document, the provision of its applicability & theological discourse of each rule from the view point of preceding & contemporary theologians & its application in Iranian civil law.
